Independent Unit 906 - International Protection of Investments and Foreign Receivables

The department is involved in creating the strategy for international and national disputes – underway or pending – arising from agreements on investment support and protection; it coordinates and resolves disputes arising from such agreements. It prepares the concept for negotiating - and negotiates – agreements on investment support and protection, and is responsible for the issue of protection of foreign investments at forums abroad. It is concerned with the issue of the free movement of capital and payments from the point of view of compliance with the international obligations of the Czech Republic. It is involved in drafting guarantee and loan agreement with foreign financial institutions. In cooperation with the Ministry of Foreign Affairs, it updates the decree stipulating allowances for business trips abroad. In the agenda of disputes arising from agreements and government guarantees concluded between the Ministry of Finance and ČSOB, it works with department 45 in the period preceding the commencement of arbitration proceedings about such disputes; after arbitration proceedings commence, it works with the Office for Government Representation in Property Affairs and the legal representative of the Czech Republic to coordinate and resolve such disputes. It performs economic analyses for the needs of conducting disputes during commencement and during the course of international disputes. It is responsible for protecting investments in connection with the resolution of international disputes at meetings with international organisations. It is responsible for managing and enforcing foreign government receivables of the Czech Republic. As part of the Public Treasury Management chapter, it manages budgetary items related to foreign receivables. It deals with disputes arising in connection with the management and enforcement of the government receivables of the Czech Republic. It prepares supporting materials for selection procedures in the area of its remit. It takes part in developing the ministry’s outputs in the fields of economic and financial policy for the OECD. It processes comments to legislative and non-legislative materials in the area of its remit and takes part in assessing the impact thereof on the area of its remit.
